A Local Law amending the Land Use Local Law of the Town of Colesville, Broome County, New York (Multiple Dwelling MD District)

Local Law 1-97

Adopted January 15, 1997

Be it enacted by the Town Board of the Town of Colesville as follows:

The Town of Colesville Law Use Local Law (Local Law No. 2-1984) be and the same hereby is amended by this Local Law as follows:

 

Section 1. Section 4.1 (Establishment of Districts) is amended by adding the following:

            Dwelling. A dwelling is any building or structure or portion thereof which is occupied in whole or in part as the home, residence or sleeping place of one or more human beings.

Multiple dwelling. A dwelling which is either rented, leased, hired out, to be occupied, or is occupied as the temporary or permanent residence or home of three or more families living independently of each other.

Recreation center. Any indoor place or enclosure which is maintained or operated for the amusement, patronage or recreation of (1) the occupants of a multiple dwelling and their guests, and (2) the general public.

 

Section 3. The schedule of regulations is amended by adding the following:

Section 4.

If any part or provision of this Local Law or the application thereof to any person or circumstances be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the

3. ACCESSORY USES TO MULTIPLE DWELLINGS

Recreation centers to be utilized by occupants of multiple

 dwellings and their guests and the general public.

(Subject to the same site plan review requirements, required on-site

parking, minimum lot size permitted, required setbacks and remarks

controversy in which such judgments shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances and the Town Board or the Town of Colesville hereby declares that it would have passed this Local Law or the remainder thereof had such invalid application or invalid provision been apparent.

 

Section 5.

All Ordinances, Local Laws and parts thereof inconsistent with this Local Law are hereby repealed.

 

Section 6.

This Local Law shall take effect immediately when it is filed in the office of the Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
