Local Law No. 5 of the year 1981

A Local Law to Regulate Traffic and Parking upon the Highways within the Corporate Limits of the Town of Colesville.
Section 1. Preamble and Enacting Clause.
For the purpose of providing for the safe and orderly use of the public highways of the Town of Colesville by the operators of motor vehicles, their passengers and other persons, the Town Board of the Town of Colesville, Broome County, New York, duly convened in regular session pursuant to the authority granted under Section 1660(a) of the Vehicle and Traffic Law of the State of New York, does hereby enact this local law.
Section 2. Definitions.
The definitions set forth in Article 1 of the Vehicle and Traffic Law of the State of New York, as the same may be amended from time to time, are hereby adopted as applicable to this local law.
Section 2A. One-Way Roadways.
2a.01 Spear Road is hereby designated for one-way traffic in a westerly direction between its intersections with Route 7 and its intersection with Allen Road. (added Dec 3, 1987 Local Law 4-1987)

Section 3. Stop Intersections.
Stop signs are authorized to be erected at the designated points of the following intersections which are hereby designated as stop intersections:
3.01 On Watrous Road at its intersection with the County Road called Ouaquaga Road controlling southbound traffic on Watrous Road at such intersection.
3.02 On Flagg Road at its intersection with West Colesville Road controlling southbound traffic on Flagg Road.
3.03 On Ridge Road at its intersection with Sanitaria Springs Road controlling westbound traffic on Ridge Road. (amended Aug 7, 1986 Local Law 3-1986)

Section 5. Parking, Standing, and Stopping.
The parking, standing or stopping of vehicles is hereby prohibited in any of the following locations:
5.01 At all times on the east side of Old State Highway Route 7 (now a Town road) 950 feet more or less from the southerly line of tax map parcel 10-5-2X reputedly owned by Central School District No. 1 (Harpursville Central School District) to the northerly line of tax map parcel 10-4-7 reputedly owned by Ronald and Barbara Mathews.
5.02 At all times on the west side of Old State Highway Route 7 (now a Town road 625 feet more or less from the southerly line of tax map parcel 4-2-5 reputedly owned by Raymond and Donna Beagell, Jr. to a point on the west side of said road

opposite the northerly line of tax map parcel 10-4-7 reputedly owned by Ronald and Barbara Mathews.
5.03 No one shall park any vehicle between the hours of 7:00 PM and 7:00 AM from November 1 to the following April 1, inclusive, whether or not licensed or operational, on any highway within this Town.
5.04 No one shall park or otherwise allow any vehicle, whether or not operational or licensed, to remain within five feet of the traveled portion of any Town or County highway in the Town of Colesville at any time when the Town is plowing snow or causing snow to be plowed from such highway.

5.06 At all times on both sides of Perch Pond Road from its intersection with Knapp Road to its intersection with Bettsburg Road, a distance of .6 miles. (Added 9/2/93 Local Law 4-93)
Section 6. Posting Requirements.
The signs authorized by this Local Law to be installed shall be of the type specified and shall be erected and maintained pursuant to the pertinent posting requirements of the Vehicle & Traffic Law of the State of New York, regulations promulgated thereunder and any other statutes and regulations of the State of New York prescribing conditions for the installation of such signs.
Section 7. Authority to Install Traffic Control Devices.
The superintendent of highways shall install and maintain traffic control devices when and as required under the provisions of this Local Law to make effective the provisions of said

Local Law and may install and maintain such additional traffic control devices as he may deem necessary to regulate, warn or guide traffic under the Vehicle & Traffic Law of the State of New York, subject to the provisions of that law.
Section 8. Removal and Storage of Vehicles.
8.01 Authority to Impound Vehicles.
When any vehicle is:
•a. parked or abandoned on any highway within the Town of Colesville during a snowstorm, flood, fire or other public emergency;
•b. is found unattended on any highway within the Town of Colesville where said vehicle constitutes and obstruction to traffic; or
•c. is parked or abandoned on any highway within the Town of Colesville where stopping, standing, or parking is prohibited,
8.02 Storage and Charges.
After removal of any vehicle as provided in Subdivision 8.01 above, the person acting on behalf of the Town may cause the storage of such vehicle in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payment to the Town highway Superintendent of the Town of Colesville of the amount of all expenses actually and necessarily incurred in effecting such removal together with any charges for storage, all such charges to be reasonable under all the circumstances.
8.03 Notice of Removal.
The person acting on behalf of the Town under Subdivisions 8.01 and 8.02 shall without delay report the removal and disposition of any such vehicle removed as provided in Subdivision 8.01 above, to the Town Clerk of the Town of

Colesville, and the Town Clerk shall ascertain to the extent possible the owner of such vehicle or the person having charge of such vehicle and notify him of the removal and disposition of such vehicle and the amount which shall be required to redeem same to the extent that such amount can be calculated at the time of giving such notice. Such notice shall be in writing and shall be mailed to the address ascertained by the Town Clerk to be the address of the owner or person having charge of such vehicle.
Section 9. Penalties for Offenses.
Every person convicted of a traffic infraction for a violation of any provision of this law which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall for a first conviction thereof be punished by a fine of not more than fifty dollars or by imprisonment for not more than fifteen days or by both such fine and imprisonments; for a second conviction within eighteen months thereafter such person shall be punished by a fine of not more than one hundred dollars or by imprisonment of not more than forty-five days or by both such fine and imprisonment; upon a third or subsequent conviction within eighteen months after the first conviction such person shall be punished by a fine of not more than town hundred fifty dollars or by imprisonment for not more than ninety days or by both fine and imprisonment.
Section 10. Constitutionality.
If any part or parts of this Local Law are for any reason held to be invalid, such decision shall not effect the validity of the remaining portions hereof.
Section 11. Repeal of Prior Ordinances.
All prior ordinances or local laws of this town regulating traffic are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for

any act done or committed in violation of any ordinance or local law hereby repealed prior to the taking effect of this local law.
Section 12. Effective Date.
This Local Law shall become effective when filed with the Secretary of State.
